These Terms of Service reflect the operation of TH - HABITAT's activities, the laws that apply to our company, and our vision.
These terms allow the relationship between the user and TH-HABITAT to be defined. In general, we authorize the user to use our services if they agree to comply with these terms, which reflect the way the business operates. When we refer to "we," "us," and "our," we mean TH-HABITAT. These terms are global, meaning they apply worldwide.
When the user opens their TH-HABITAT account, they accept these terms of service.
These Terms of Service help define the relationship between TH - HABITAT and the user regarding the user's interaction with our services. For example, these terms include the following topics:

What we expect from the user, which sets out some rules for using our services.
Content in TH-HABITAT services, which describes the intellectual property rights relating to the content available in our services, which may belong to the user, to Google or to third parties.

It is important to understand these terms because, in order to use our services, you must accept them.
In addition to these terms, we also publish the Privacy Policy. Although they are not part of these terms, we encourage users to read them to better understand how they can update, manage, export, and delete information.

Our services have been designed to work together in order to allow users to switch more easily from one activity to another.
We constantly develop new technologies and features to improve our services.
We follow a rigorous product research program, therefore before modifying or discontinuing the offer of a service, we take into account the user's interests, their reasonable expectations, and the potential impact on the user and others. We modify our services or discontinue their offer only and exclusively for valid reasons, such as to improve performance or security, to comply with the law in order to prevent illegal activities or unlawful behavior, to reflect technical developments, or because a feature or an entire service is no longer sufficiently used or convenient.
If we need to make substantial changes that negatively affect your use of our services or if we discontinue offering a service, we will give you reasonable advance notice.

Although it grants the user permission to use its services, TH-HABITAT retains all intellectual property rights it holds regarding its services.
freedom of sharing
Some of our services are designed to allow the user to upload, send, store, forward, receive or share their own content. The user is not required to provide any content on our services and is free to choose which content to provide. If the user decides to upload or share content, they must ensure they have the necessary rights to do so and that such content is lawful.
User content remains their property, meaning that the user retains all intellectual property rights they hold regarding their content. For example, the user holds the intellectual property rights to the creative content they produce, such as the articles they write. When content is shared through our services, the user has nothing to claim. The user may also have the right to share the creative content of others if those individuals have authorized the user to do so.
If the user's intellectual property rights limit our use of the content, the user will need to grant us authorization. This authorization is automatically granted to TH-HABITAT at the time of registration.

This license does not affect the user's data protection rights because it only concerns their intellectual property rights.
This license does not cover the following types of content:
Concrete publicly available information provided by the user, such as corrections to the address of a local business. Such information does not require a license because it is considered public domain information that can be freely used by everyone.
Feedback provided by the user, such as suggestions to improve our services.
This license allows TH-HABITAT to:
to host, reproduce, distribute, communicate and use the user's content; for example, to save it on our systems and make it accessible wherever the user goes.
to publish, publicly perform or publicly display the user's content, if the user has made it visible to others.
to modify the user's content, for example by reformatting or translating it.
to license these rights to:
Other users to allow the intended operation of the services, for example by allowing the user to share photos with people of their choice.
Third-party service providers who have signed contracts with us, who comply with these terms, only for the purposes described in the purposes section below.
This license is for the sole purpose of:
Manage and improve services, that is, allow the intended operation of the services and create new features and functionalities. This includes the use of algorithms and automated systems to analyze user content:
In order to detect spam, malware, and illegal content.
In order to personalize our services for the user, for example by offering personalized content, not for advertising purposes.
This analysis occurs when the contents are transmitted, received, and stored.
Use content publicly shared by the user to promote the services. For example, to promote a TH-HABITAT service or app, we may quote a review written by the user.
Develop new technologies and services for TH-HABITAT in accordance with these terms.
Duration
This license will last as long as the user's content is protected by intellectual property rights. Even when a paid premium subscription is terminated.
If the user removes from our services any content covered by this license, our systems will stop making such content publicly available within a reasonable period of time. However, there are two exceptions:
If the user has already shared the content with others before removal. For example, if they shared a photo with a friend, who then made a copy or shared it again, then the photo may continue to be visible in the user's friend's TH-HABITAT Account even if the user has removed it from their own account.
If the user makes their content available through services of other companies, it is possible that search engines may continue to find and display such content in search results.
The user is responsible for the actions they take with their TH-HABITAT Account, including taking reasonable measures to protect the account, and for this purpose we encourage the user to keep their password protected and change it regularly for their own security.
To offer our services, we sometimes send users service announcements and other information. For more information about how we communicate with users, please read the Privacy Policy of TH-HABITAT.
If the user decides to send us feedback, such as suggestions to improve our services, we may act on it without any obligation towards them.
User content
Some of our services give users the opportunity to make their content publicly available. For example, users may publish articles, or upload their own posts in the My Social and Thematic Forum areas.
If the user believes that someone is violating their intellectual property rights, they can send us a notification of the violation and we will take appropriate action. For example, we suspend or close the Account of those who repeatedly violate copyright, as indicated in the previous points.

In none of the shared spaces does TH-HABITAT tolerate disrespectful, racist, or otherwise offensive communications against the dignity of users. If we detect or receive notification of such behavior, we will remove the content from our platform and close the account of the user in question. We will not be able to remove the same content from third-party platforms or from the web, in case other users have already shared the content.
If we reasonably believe that user content (1) violates these terms, violates applicable law, or may harm our users, third parties involved, or TH-HABITAT, we reserve the right to remove such content, in whole or in part, in accordance with applicable law.
Service interruption
TH-HABITAT reserves the right to suspend or terminate the user's access to premium services or to delete their Account in the event that one of the following situations occurs:
The user substantially or repeatedly violates these terms of service.
We are required to act in this way to comply with a legal requirement or a court order.
We reasonably believe that the user's conduct causes harm or liability to another user, a third party, or TH-HABITAT, for example due to hacking or phishing activities, harassing behavior, inclusion of spam, misleading attitudes, or taking content from other sites that do not belong to the user.
the user has not paid the membership participation fee.
If the user believes that their Account has been suspended or closed by mistake, they can appeal by sending a clarification email.
Obviously, the user can stop using our services at any time, as long as they are up to date with the membership payment.
Further information
By law, the user has certain rights that cannot be limited by a contract such as these terms of service. These terms are not intended in any way to limit such rights.
If a specific provision proves to be invalid or unenforceable, such unenforceability shall not extend to the other provisions.
If the user does not comply with these terms, our failure to promptly take action cannot be interpreted as a waiver of our possible rights, such as the right to take action in the future.
We may update these terms in order to reflect changes made to our services or to the way we operate. For example:
Should we substantially modify these terms, we will notify the user well in advance, offering them the opportunity to review the changes, except
if we add new services, features, technologies, prices or benefits (or remove old ones) for legal, regulatory or security reasons, or to prevent unlawful behavior or harm.
in the case of launching new services or features, or in urgent situations such as preventing the continuation of an unlawful act or meeting legal requirements. If the user does not accept the changes made to the Terms, they are required to remove their content. The user may choose to terminate their relationship with TH-HABITAT at any time by closing their Account or stopping the membership payment.
